Michigan’s Protection from Intimate Deep Fakes Act and Federal TAKE IT DOWN Act
Business attorneys Alex Rusek and Lindsey Mead co-authored the following article in the Summer 2026 edition of the State Bar of Michigan's Litigation Journal.
The article explains how the rapid growth of generative AI has made it easier to create realistic “deep fakes,” particularly nonconsensual sexually explicit images and videos. In response, Michigan enacted the Protection from Intimate Deep Fakes Act (Public Act 11 of 2025), while Congress passed the TAKE IT DOWN Act at the federal level. Together, these laws aim to provide remedies for victims and impose consequences on those who create or distribute harmful intimate deep fakes.
