On February 4, 2022, the Michigan Attorney General, Dana Nessel, issued an Opinion stating that restrictions for virtual public meetings provided under the Michigan Open Meetings Act are preempted to the extent the restrictions prevent a public body from providing reasonable accommodations under the Americans with Disabilities Act.
March 31, 2021MDHHS order which is effective immediately, exempts public meetings from the 25 person limit. The meetings will instead be subject to the capacity limits of the venue.
Imagine that you are the head of your municipality and you receive a frantic call from a constituent. The constituent says “Hey, Mr. Supervisor- I live in a residential subdivision and my next door neighbor is growing 72 marijuana plants in his backyard! I thought he couldn’t do that unless there was an ordinance allowing it? What are you going to do about it?”
