United States Supreme Court Upholds Patient Protection and Affordable Care Act

On June 28, 2012, the United States Supreme Court issued its long awaited ruling regarding the constitutionality of the Patient Protection and Affordable Care Act (“PPACA”).  In a 5-4 decision, the Supreme Court upheld PPACA, including the individual mandate that requires individuals to obtain health care insurance coverage or pay a penalty.  The Supreme Court reasoned that the individual mandate was constitutional as an exercise of Congress’s power to tax.  A comprehensive overview of the Court’s decision will be provided in subsequent E-Blasts.  In the interim, please contact your Foster Swift employee benefits professional if you have any questions regarding PPACA.
