Successful Defense of Lanham Act Suit

Elderly Instruments, one of the country's largest dealers in used and vintage instruments advertised a vintage handmade banjo as a "Gibson Clone." Gibson brought a suit alleging claims under the Lanham Act for violation of Gibson's trademarks and trade dress. Success in preliminary motions for partial summary judgment allowed the case to be settled on favorable terms.
